Terms and conditions


Please read your Vacation Rental Agreement carefully before you begin your vacation. Any monies received indicated the acceptance of the terms of our Vacation Rental Agreement in full. All policies are strictly enforced. It is the responsibility of all Guests and members of their party to be familiar with all policies pertaining to rental.

The City of St Augustine has passed legislation to regulate Short Term Rentals and The City of St Augustine is starting regulation. We must be sensitive to the local residents and environment. We take violations very seriously. Please be on notice that failure to abide by any of these rules will result in forfeiture of the Security/Damage Deposit for the first infraction (or complaint by neighbors or police). A second violation can result in eviction.

CHECK-IN will be after 3:30 PM. Check-out will be by 10 am. Please understand we have to adhere to a strict checkout schedule. We have only a few hours to prepare the home for the next Guests. We will have to assess a late fee if they are delayed entry.

PETS: Guest shall not bring any pets of any kind to the Property. Violation will result in automatic forfeiture of security deposit and eviction.

SMOKING: No smoking of any kind is allowed inside the house. Violation will result in automatic forfeiture of security deposit and eviction.

PARKING: Each home has assigned parking. No recreational vehicles, trailers or boats are allowed.

NOISE: There can be no excessive noise or wild parties. The City requires quiet time after 10 PM. We ask there be no outside music at anytime. This is a residential neighborhood and we ask you to be sensitive to the needs of the local residents. This is a very serious issue and will be strictly enforced. To protect our operating license, the security deposit will be forfeited for a complaint.

WEDDINGS OR PARTIES: We do not allow weddings, receptions, parties or events without written permission. And there should be no Guests other than disclosed on the Rental Agreement.

FIREWORKS & FIRES: By law, fireworks and fires are not permitted at Beach and we do not allow them at the house. The security deposit will be forfeited and you will be asked to leave if ANY fireworks are used.

PLUMBING: Do not put any feminine products, baby wipes or paper towels in the toilet, only toilet tissue. The toilets are water-saving models and don't have a strong flush - limiting the amount of toilet paper used will help prevent a clog. Plungers are provided if a clog occurs. Please do not pour grease down the drain.

RIGHT OF ENTRY: Guest(s) agree that Management reserves the right to enter the rental property any time to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements as we may deem appropriate.

SECURITY & SAFETY RISKS: Always lock Doors when you leave. When you rent, you assume responsibility for it and its contents, as well as your personal property. Always lock the doors and windows when you leave. Children are welcome, but there are conditions in and around the home that may pose hazardous to them, as well as to adults. We do not assume any responsibility for injuries resulting from your failure to use due caution. Children must be supervised at all times. Candles are not allowed due to fire hazard.


The Property shall be in the same condition upon departure as at check-in. Normal wear and tear excepted.

Guests may cook only in designated cooking areas not under the porches.

Guests must immediately notify Management or its agents of fire, water or other damage to the Property including, for the Beach Homes, if the red light comes on in the parking lot which means there is a possible problem with the sewage system.

Guests shall be liable for all acts of the family, invitees, employees, or other persons invited onto the Property.

Guests may not sublet or assign this rental agreement.

Guests shall be responsible to return all keys and all beach equipment and furniture should be put back to its original position.

Guests shall abide by the House Rules of the Owner as provided to Guest.

Guests understand that if this is an ocean front property that the ocean and beach has certain inherent risks. The guests have the responsibility to make themselves aware of any and all risks associated with the ocean and beach environment.

Guests understand that if this is a multi unit home and they do not rent the entire Home the other unit may be rented to other Guests during their stay. Both units are completely separate and no space is shared.


Guests are required to make a Security Deposit to protect against any damages to, and/or loss of, items from the Property. If there are no damages or losses, and the no pet, smoking or rule violations, the deposit will be promptly returned within 2 weeks of your departure. In the event there is damage to our home in excess of the Security Deposit caused by the guest during their stay, said guest is responsible for payment of any additional damages. In the event of nonpayment by the guest for additional damages, if we are forced to seek payment through legal channels, any and all costs incurred by the the Property Manager to recover lost damages will become the responsibility of the Guest.


Cancellation of a booking may result in forfeiture of rental deposit, excluding the Sales Tax & Security Deposit portion. Refund of monies paid for rental and services will be made only under the following circumstances: 1) The home becomes unfit for habitation; 2) The home is re-booked for the same period and at the same rate of initial booking or 3) Unexpected Double Booking. If a portion of the rental time is re-booked, a pro-rata refund will be made. All refunds of rental-service payments, whether in whole or pro-rata, will be subject to the deduction of $150 cancellation fee. To protect against cancellations caused by certain unforeseen events, such as illness, we recommend that Guests purchase trip cancellation insurance. In the event of a hurricane, refunds will be made in the event of a "Mandatory" evacuation by governmental authorities. Refunds will be granted from the day of the mandatory evacuation.

EMERGENCIES/ MAINTENANCE: In the event of a problem please immediately contact Linda Bayles at 904-465-3852 and leave a message or Text if no answer. If it is after office hours we will make every effort to return your call as soon as possible. If we do not promptly return your call and it is an urgent situation, you may call James Bayles at 904-307-6971. Otherwise, you will be contacted during normal business hours.

SATELLITE TV, INTERNET & PHONE CALLS: All properties are privately owned and have different subscription packages for cable and/or satellite and internet. We do not guarantee any programs, events or reception. Guest(s) are liable for ordering any Pay Per View - if Guest(s) does not use their own credit card for ordering, programming charges plus an additional $5.00 processing fee will be charged to the credit card we have on file. Some properties are equipped with a telephone; short calls within the U.S. are permitted.

INDEMNIFICATION & HOLD HARMLESS: While we strive to maintain our Vacation Properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All Guest(s) and their invitees use the Vacation Property structures and premises at their own risk.We shall not be held liable or otherwise responsible in any way for injury to any Guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said Guest(s) and/or invitees, or by the failure of structures, appliances, (including BBQs) furnishings, and/or other equipment, whether by malfunction, misuse, acts of God/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the Vacation Properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the Vacation Property and/or its contents. We shall not be held liable nor otherwise responsible in any way for allergic reactions to Guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the Vacation Property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, and/or other equipment. By written or electronic endorsement of this Agreement, Guest(s) and invitees hereby agree to forever hold-harmless and indemnify the Owner and the Property Manager against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the Guest(s) use of the property.
